TWENTY 100+ YEAR OLD FIJI LAWS SURVIVE TODAY

The Attorney-General claimed on Thursday 5 November 2009 that the Penal Code is over 100+ years old. We were miffed by that claim and checked. It dates back to 1 May 1945 and may have survived the war and several coups, but still, there’s no reason to exaggerate! Yep we didn’t think it was that old. So we compiled a list of laws which are over 100 years old and are currently in use. We should hold a national celebration of the centenary of these 20 laws. History buffs take note. If you find a law older than on our list, or not on our list, we’ll celebrate. According to our research, you’ll be surprised that the oldest surviving and still quoted in a case this year and recently amended on 7 July 2009 is an Act actually passed in 1875. NOT JUST DUAL CITIZENSHIP BUT MULTIPLE CITIZENSHIP!

 

Multiple citizenship is now a reality in Fiji with the release of the Citizenship of Fiji Decree 23/2009 and the regulations.

 

Part 5 of the Decree allows persons who have acquired the citizenship of one or more countries to apply either by registration or naturalization for multiple citizenship.

What are “annotated laws”?

They are revised laws of Fiji with full historical notes, value added case references and judicial comments, and pointers to other useful laws which cross-reference that law. These features help a lawmaker or user discern the purpose of the law, how the courts have interpreted various sections of the law, and point to other laws which impact that law.

Justice Nazhat Shameem, formerly of the High Court of Fiji described it thus:

“The Annotated Laws provide full and helpful footnotes which comment on particular sections of the law in light of judicial decisions. The Annotated Laws therefore provide a direct source of local common law and statute in one volume. When a judge is working to a strict schedule, and has limited time to look up authorities in order to deliver rulings in the course of trial, such a research facility becomes immensely useful….”

Current users - the judiciary, DPP, Legal Aid Commission, FICAC, major accounting firms, various statutory bodies, some commercial organisations, various law firms, an insurance firm and banks - find it a useful adjunct to their legal research. You cannot follow the rule of law unless you know what the rule is.
